Upper secondary education or the equivalent.

The purpose of the course is to provide insight into basic rules, principles and practices in relation to family and succession law in order to develop the students' ability to explain, identify and deal with basic problems and questions related to family and succession law.

Family law relates first and foremost to: - The rules on entering into marriage. - The legal position between married persons in relation to i.a. spousal support, property matters, and spousal agreements. - The law on separation and divorce, i.a. legitimate reasons, and the provisions on how to deal with the estate. - The legal position of unmarried couples generally, and in relation to separation. - The law on children in relation to paternity, parental authority, custody and access, and maintenance. Succession Law covers the law that governs the transmission of property rights to others in relation to the death of the holder of those rights. This part deals with i.a.: - The rights of inheritance of family and spouses. - The law on wills and donations mortis causa. - The right to renounce one’s inheritance right. - Quantitative and qualitative methods of accounting for the inheritance. In addition to the above mentioned, the course begins with an introduction to basic principles of Family and Succession Law, the position of Family and Succession Law as a matter of Faroese special competence included.

40 hours. The classes will mainly consist of presentations from teacher. If circumstances permit, classes will also include student exercises and student presentations.

The students shall be able to: - demonstrate concrete and broad knowledge on the subject of family and succession law, and be able to analyze the legislation, practice and theory related to the subject. - be able to explain the rationale behind the different rules and principles related to family and succession law. - based on the legal sources within the field, systematize and analyze specific family and succession law problems. - argue clearly and precisely how a problem within family and succession law can be solved or prevented. - make a reasoned choice in situations of different possible legal solutions. - present and formulate knowledge and arguments correctly and succinctly in eloquent and correct language.

4 hour written exam. The student will have access to the course material and other materials from the classes. It is a precondition for the exam that the student has submitted a written home assignment in the middle of the semester, that has been approved by the teachers.

Materials for family and succession law, consisting of excerpts from textbooks, court and administrative decisions, prepatory work from parliamentary bills etc., available on the Moodle network prior to teaching sessions. Required reading about 500 pages.
