Prerequisites
Bachelor’s degree or equivalent with adequate component of law.
Purpose
To provide insight into Banking Law as a distinct legal discipline. The course aims at MA students in law, but others will find the course useful, not the least employees in the banking sector, but also regular citizens.
Content
The course Banking Law covers the main regulation regarding banks and is relevant for business lawyers, auditors, employees in banks, other financial advisors, and others with interest in the area. The course will relate to and cover these main areas in banking law: • Banking Law in the society • License and business areas • Professional secrecy • Deposits and loans • Payment services • Customer protection and good banking practices • Management regulations • Capital requirements and risk management • Danish Bank Packages • Winding up distressed banks • Investor Protection • FSA (Financial Supervisory Authority) • Anti-Money-Loundering, whistleblowing, and social responsibility • New technologies, challenges, and possibilities
Learning and teaching approaches
Approx. 40 hours teaching that mainly will be organised as lectures from the teacher and exercises and discussions in the class.
Learning outcomes
After completing this course, the student shall be able to: • Explain basic banking law and basic rules and principles within the discipline. • Find, explain and assess the importance of different types of legal sources and practice relevant to banking law. • Explain the purpose and considerations behind the law on banking law seen in the context and interest of the community. • Explain and analyse alternative solutions to difficult cases, and in a reasoned manner point towards preferred solutions. • Give legal advice about banking law. • Present and formulate knowledge and arguments within banking law correctly and succinctly in eloquent and correct language.
Assessment method
Written 24-hour home assignment counts for 2/3 of the grade. A written multiple-choice assignment counts for 1/3. One single grade is given. It is a precondition for the final exam that the student has passed the multiple-choice assignment, assessed as an independent performance.

Finansret – bank, realkredit, investering, pension by Linda Nielsen, 1st edition 2019, Jurist- og Økonomforbundets Forlag 2019, is the basic work. Decisions, opinions, awards etc. will also be part of the written materials. Reading list will amount to approximately 600 pages.
