Purpose
The purpose of the course is to provide the students with knowledge about law and legislation relevant to fishery in the Faroe Islands, and for fishery from Faroese vessels. This would amount to, for example, general principles of administrative law, the specific organization of the fishery administration, rules on fishery in Faroese waters, and waters of foreign countries where Faroese authorities have negotiated rights, etc.

Føroyska samfelagið gagnnýtir tað fiskatilfeingi, sum er undir løgræði hjá føroyskum myndugleikum. Føroyskir myndugleikar skipa útvinning av hesum fiskatilfeingi við lóggávu, sum heimilar, at einstaklingar og feløg fáa rættindi til ávísan fiskiskap. Settar verða hesum einstaklingum og feløgum ymiskar treytir, sum framganga av lóg og kunngerð á økinum og teimum loyvum, sum verða útskrivað. Skeiðið viðger hesa lóggávu saman við teimum altjóða reglum, ið hava týdning fyri regulering av fiskiveiðu. Greitt verður gjølliga frá skipanini við at veita loyvi, herundir - hvør veitir loyvi. - hvør kann fáa loyvi (persónar, feløg, útlendingar). - avmarkingar í mun til miðsavnan av rættindum. - hvørji sløg av rættindum eru. - hvørjar treytir fylgja við rættindum, og undir hvørjum fyritreytum kunnu loyvi verða mist/tikin aftur v.m. - tíðar- og økisbundnar avmarkingar í rættinum at fiska. Komið verður inn á høvuðsmunir í lóggávuni áðrenn og aftaná lógarbroytingina, sum fekk gildi frá 1. januar 2018. Viðgjørd verður skipanin av fiskiskapi í føroyskum sjógvi og við føroyskum skipum uttan fyri føroyskan sjógv, herundir kvotaskipanir og almennar ásetingar fyri fiskiskap. Til viðgerðar er eisini spurningurin um avhending av rættindum at veiða og undir hvørjum treytum, slík avhending kann fara fram v.m. Støði verður í stóran mun tikið í galdandi lóggávu, t.e. serliga lóg um fyrisiting av sjófeingi, sum kom í gildi 1. januar 2018, umframt tilhoyrandi kunngerðum. Umsitingin av økinum er fevnd av vanligum fyrisitingarrættarligum grundreglum, herundir kravinum um sakliga fyrisiting, krav um heimild fyri at taka avgerðir, krav um grundgeving, innlit v.m. Skeiðið tekur tí eisini støði í vanligum fyrisitingarligum grundreglum í tann mun, hesar eru viðkomandi fyri fiskiveiðilóggávu og -umsiting. The Faroese society exploits the fishery resources under the jurisdiction of Faroese authorities. The Faroese authorities organize the exploitation of these fishery resources via legislation that grant individuals and companies certain fishery rights. These rights are typically granted on certain conditions, which follow from law, administrative regulation or the licenses themselves. The course deals with this legislation, and the international legal rules of relevance for regulation of fishery are also taken into account. The licensing system is described in detail, including - which administrative instance issues licenses. - who can get a license (individuals, companies, foreigners). - limitations in relation to accumulation of rights. - what different kind of rights exist. - what conditions accompany the issuing of fishery rights, and under what circumstance these rights may be limited / withdrawn, etc. - temporal and territorial limitations on the right to fish. The main differences between the legal position before and after the legal reform, that came into force on 1st of January 2018, are also covered. The organization of fishery in Faroese waters, and from Faroese vessels outside Faroese territory, including quota systems and general fishery regulations, will also be treated. And the question about the extent that fishery licenses can be traded on the market, and the conditions for such transactions, is also included. The course is to a large extent centered around the main legislation in the area, especially the Act on the Administration of the Sea Resources, with accompanying administrative regulations, which mainly entered into force on 1st of January 2018. The administration of this area is also to some extent subject to basic principles of administrative law, including the prohibition of arbitrariness, the requirement of legal warrant (or authorization) for administrative acts, the reason-giving requirement, public access, etc. To the extent this is relevant for the regulations and administration of fishery, the course therefore is also revisiting general principles of administrative law.
Learning and teaching approaches
38 hours. The teaching will be mainly organised as lectures and exercises.
Learning outcomes
After completion of this course, the students should be able to: - Demonstrate general and concrete knowledge of main subjects within Faroese fishery law. - Explain the interaction between fishery law and other legal disciplins, such as property and administrative law, which implies interpretative difficulties specific to fishery law. - Analyse difficult concrete cases in relation to fishery law, and demonstrate knowledge and mastery of all relevant sources of law and methods of interpretation. - Analyse the reform and development that lately have taken place within Faroese fishery law. - Communicate this knowledge in an academically responsible and well organised manner.
Assessment method
External examination (together with teachers) 4 hour written exam. The students are allowed to bring all teaching materials and personal notes to the exam table.
